Ich habe gestern einen Entwurf einer "Free Music Definition" an
die Free Music Mailingliste auf gaos.org geschickt. Es ist eine
veränderte Version der Debian Free Software Guidelines...

Änderungen:
o Als sprachliche Anpassungen wird "software" ersetzt durch
"art" und "program" durch "work". Debian-spezifische Verweise
sind analog zur Open Source Definition verallgemeinert.
o Zu Punkt 6 wird hinzugefügt:

| make it perceptible from a recording or broadcasting.
Daß eine Lizenz diese Dinge nicht verbietet, reicht für
Nicht-Software nicht aus.
o Punkt 4 führt zu Lizenzinkompatiblität. Also besser weg damit.
o Punkt 2 (Source Code) ist problematisch:
o In "Source Code" und "Binary" zu unterscheiden ist nur dann
sinnvoll, wenn das Binary mittels eines compiler-artigen
Programmes vollautomatisch aus dem Source Code entsteht
(z.B. eine WAV-Datei aus einem XM). D.h. der Stand der
Technik bedingt Werke ohne Sourcecode. Eine freie Lizenz
dürfte solche Werke als Derivat eines Werkes mit Source
Code nicht verhindern.
o Möglicherweise wird ein Binary ganz oder auszugsweise
manuell weiterverarbeitet (z.B. durch Sampling). Es wäre
dann Schikane, den Source Code des Binarys weitergeben zu
müssen. Eine entsprechende Ausnahme könnte jedoch durch
minimale manuelle Veränderung absichtlich ausgenutzt werden.
o Manchmal steht die Größe des Sourcecodes in keinem
Verhältnis zum Binary (z.B. 1 GB Cubase-Daten für 4 MB
OGG-Musik)
Ich bin mir nicht sicher, ob man für Kunst die Forderung nach
dem Source Code nicht komplett knicken und stattdessen als
freiwilliges Qualitätsmerkmal ansehen sollte.

Free Art Definition
1. Free Redistribution
The license of a free work may not restrict any party from
selling or giving away copies of the work as a component of an
aggregate art distribution containing works from several
different sources. The license may not require a royalty or
other fee for such sale.

The license must allow modifications and derived works, and must
allow them to be distributed under the same terms as the license
of the original artwork.

The license must not discriminate against any person or group of
persons.
6. No Discrimination Against Fields of Endeavor
The license must not restrict anyone from making use of the
work in a specific field of endeavor. For example, it may not
restrict the work from being used in a business, or from
being used for genetic research.
The license must allow to display the work, to recitate, to
perform or otherwise demonstrate it, to broadcast it and to make
it perceptible from a recording or broadcasting.
7. Distribution of License
The rights attached to the program must apply to all to whom the
program is redistributed without the need for execution of an
additional license by those parties.
8. License Must Not Be Specific to a Certain Project
The rights attached to the work must not depend on the
work's being part of a certain art distribution. If the work is
extracted from that distribution and used or distributed within
the terms of the work's license, all parties to whom the work is
redistributed should have the same rights as those that are
granted in conjunction with the original art distribution.
9. License Must Not Contaminate Other Art
The license must not place restrictions on other art that
is distributed along with the licensed art. For example, the
license must not insist that all other works distributed on the
same medium must be free art.
